Wisconsin Sex Crime Law For Child Pornography

According to Wisconsin law, possession of child porn is a Class I Felony for defendants under 18 years and a Class D felony for defendants 18 years or older. Child porn includes undeveloped film, photographic negatives or photographs, video films and any other record showing a child engaged in sexually explicit behavior. Wisconsin recently passed a law that requires a three year mandatory period of confinement in prison for possession of child pornography. If the accused is 18 or over, penalties include fines of up to $100,000 and imprisonment of up to twenty five years. If the accused is under 18 years, penalties include a fine of $10,000 and/or up to three and a half years imprisonment. If there are prior convictions, the penalties are harsher. This is also a violation of federal criminal law, where penalties are more severe.
